Terms of Service

Spaya ("we", "us", "our") is a spa day pass marketplace currently in development, operating at getspaya.com. Our platform will connect guests with hotel spas, wellness centres and spa partners in Lisbon and, in the future, other cities.

These Terms of Service ("Terms") govern your access to and use of the Spaya website and waitlist. By visiting our website or joining the waitlist, you agree to these Terms.

If you do not agree with these Terms, please do not use our website.

Spaya is currently in pre-launch phase. The platform is not yet open for bookings. The website at getspaya.com serves as an informational landing page and waitlist registration only.

By joining the waitlist, you:

• Express your interest in using Spaya when it launches
• Provide your email address to be notified of our launch and updates
• Do not enter into any booking, payment or service agreement

We do not charge any fees for joining the waitlist. Joining the waitlist does not guarantee access to the platform upon launch.

3.1. To join the Spaya waitlist, you must provide a valid email address.

3.2. By submitting your email, you agree to receive communications from Spaya about our launch, updates and early access opportunities.

3.3. You can unsubscribe from waitlist communications at any time by clicking the unsubscribe link in any email we send, or by contacting us at hello@spaya.com.

3.4. We will not share your email address with third parties for marketing purposes. See our Privacy Policy for full details on how we handle your data.

To join the Spaya waitlist you must be at least 16 years of age. By submitting your information, you confirm that you meet this requirement.

5.1. All content on the Spaya website — including the name, logo, design, text and images — is owned by or licensed to Spaya and protected by intellectual property law.

5.2. You may not copy, reproduce, distribute or create derivative works from any Spaya content without our prior written consent.

When using the Spaya website, you may not:

• Submit false or misleading information
• Attempt to interfere with or disrupt the website or its infrastructure
• Use automated tools to scrape or extract data from the website
• Impersonate any person or entity
• Violate any applicable law or regulation

7.1. The Spaya website is provided "as is" and "as available" without warranties of any kind, express or implied.

7.2. We do not warrant that the website will be uninterrupted, error-free or free of viruses or other harmful components.

7.3. Any information about planned features, launch timelines or services described on the website is provided for informational purposes only and does not constitute a binding commitment.

To the maximum extent permitted by applicable law, Spaya shall not be liable for any indirect, incidental, special or consequential damages arising from your use of or inability to use the website or waitlist service.

When the Spaya platform launches and booking services become available, updated Terms of Service will be published covering bookings, payments, cancellations, vouchers and all other relevant matters. You will be notified of updated Terms before using any booking services.

We may update these Terms from time to time. We will notify waitlist members of material changes by email. The current version is always available at getspaya.com/terms.

11.1. These Terms are governed by and construed in accordance with the laws of Portugal.

11.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

11.3. If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
